Article 1 : Préamble

The purpose of this contract is to determine the rights and obligations of Lisa Longo, animal behavior consultant, hereinafter called the Seller, and of the natural or legal person benefiting from her services who will be called the Client.

By making an appointment or paying for the service, the Client declares to accept without reservation the terms of this service as well as all of these general conditions of sale. These will prevail over any other general or specific conditions not expressly approved by the Seller. The Seller reserves the right to modify her general conditions of sale at any time without notice: the applicable conditions will be those in force on the date of making an appointment or payment by the Client.

The GSC are made available to the Client on the website www.animal-academie.com or sent by email or message at the latter's request.

Article 2: Field of intervention and nature of the services

Lisa Longo (commercial name Animal Académie) is a self-employed company subject to VAT and performs the following services: consultation at the Client's home or outside, online consultation, online coaching, for advices in canine, feline and avian behavior and education.

The duration of the appointments cannot be defined in advance, because it depends on the analysis of the behavior and exchanges between the Seller and the Clientr. The price will have been defined beforehand, either by being written on the website of the seller www.animal-academie.com either by phone, message or email. The appointments include a behavior analysis phase and the proposal of a behavior modification action plan.

Article 3: Obligations of the Seller

The Seller's obligations are obligations of means, but she will make every effort to best achieve the objective determined with the client. Under no circumstances may the Client require results, these being linked to the Client's ability and involvement in implementing the behavior modification plan, but also to the reactions specific to the animal, a living being whose reactions can be unpredictable.

Article 4 : Ethics

The Seller, certified Elite Fearfree Professional Trainer, undertakes to always respect the physical, psychological and emotional well-being of the animals he encounters, as well as to show kindness and empathy to the Client.

Article 5: Clients Obligations

The Client is defined as the person who contacted Lisa Longo or Animal Académie and/or who is present during the appointment.

The Client undertakes to keep an identified animal, legally in good standing with the legislation of the country in which he lives. The client agrees to be the holder of a liability insurance mentioning the coverage of domestic and/or captive animals.

The Client undertakes to make available to the Seller all the means necessary for the performance of the services defined within the agreed period.

The Client must be of legal age and capable, and have full legal capacity.

The Client is aware that personal work guarantees the success of the plan. If the recommendations were not applied, the Seller cannot be held responsible for the failure of the process.

During the sessions, the Client must maintain control of its animal (keep the dog on a leash, for example), unless otherwise indicated by the Seller as part of a training exercise.

The Client is designated as the owner of the dog. He is responsible for it. The Client is responsible for the good behavior of his pet.

In the event of a bite or injury by the animal held by the Client on the Seller or any other individual, the owner of the animal must submit to regulatory controls. He will have to cover, through his insurance, the costs resulting from the accident.

The Client will be responsible for damage caused by his pet, on himself or on others.

Article 6: Commitment, cancellation, delay

Commitment: Requests for consultations and interventions proposed by e-mail, contact form, message or by telephone commit the Client from the start of the intervention at the private place of the interview.

Cancellation: Consultations can be canceled up to 48 hours before the scheduled time. After this period, the service would be considered as carried out and one hour of consultation as well as the travel expenses will be due by the Client.

If the Seller must exceptionally cancel a consultation, he undertakes to notify the Customer as soon as possible and to offer him another date that would suit both parties.

Delay: the Seller performing her services at the Client's home, the time of arrival may therefore be subject to traffic conditions sometimes slowed down depending on the time. She therefore undertakes to notify in the event of any delays within a reasonable time.

On the other hand, for any home session, the Client agrees to be present at its home when the Seller arrives. Any possible delay would therefore be deducted from the duration of the appointment. A delay of more than 15 minutes will be considered as a cancellation of appointment and the rules mentioned above will then apply.

Article 7 : Prices

The Seller reserves the right to modify her prices at any time.

Article 8 : Payment method

The Seller accepts payment by check or bank transfer in priority. Cash payment may be accepted. Payments by check will be payable to Lisa Longo or Animal Académie.

For online or home consultations, the Client must pay the full amount at the end of each session.

Late payment charges are shown on each invoice.

Article 9 : Privacy

Lisa Longo is bound by professional secrecy in the context of her activity and undertakes not to disclose any information or confidence relating to the private life of her Client whithout permission. The Client agrees, reciprocally, to a general obligation of confidentiality relating to all oral or written information, whatever the format, exchanged during the service, and throughout the duration of the follow-up as well as after its deadline.

Article 10 : Intellectual property

All elements relating to the content of the services and relating to the Seller's website are protected by Copyright and remain the exclusive intellectual property of the Seller. It is forbidden to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, these elements, in any form whatsoever (paper version, numeric), and whatever the language, without the Seller’s explicit and formal agreement.

Article 11 : Litigation

The parties undertake, in the event of a dispute of any nature, to attempt an amicable settlement of this dispute. They undertake to do their best to ensure that this amicable settlement has every chance of succeeding and to demonstrate all the necessary good faith.
